Section 56 (1) of the Abolition of Feudal Tenure etc. (Scotland) Act applies Part 3 of the Act to teinds in that they are extinguished from 28 November 2004. Originally, teinds were the right of the church to a tenth part of the produce of the land, but latterly, it was the right to a monetary payment to the person holding the teinds for a particular piece of land. Because they fell into the class of property known as ‘separate tenements’, teinds could, in principle, form an interest in land capable of registration in their own right. The situation where a registration officer is most likely to encounter teinds is where they are included amongst the pertinents in a disposition of some other subjects. The upshot of the change is that teinds are now of no significance and no mention requires to be made in the title sheet.
