Convert FR/VR to DW following KIR

Process Steps

Additional Information

Where, following on from a property registered under KIR, an application for first registration is received, this will be identified during the Intake FR process and passed to complex Dealings to be processed as a dealing of whole application.

Intake officer

1.1 Complete examination steps following the appropriate Intake officer and Initial Examination process steps for Complex DWs.

If the application was created as an FR and cancelled on LRS the DW application must be recreated on same day to ensure the correct information is sent by the notification handling system.

Plans Officer

1.1 Verify the property extent corresponds to the extent registered under the KIR application.

1.2 If the extent is the same add a note to the application workdesk informing the legal officer that "extent of property corresponds to the KIR extent".

1.3 If the extent differs:

1.3.1 Add a note to the application workdesk advising "the extent of the property in the application differs from the extent created under KIR, please consider and take any remedial action".

1.3.2 Release application to Plans settle and send to KIR team to assess impact on this and adjoining KIR titles.

Legal Officer

1.1 Complete the application following the Legal Settle Complex DW process. In addition to this and where appropriate

1.1.2 Check the rights in the application correspond with the registered rights.

1.1.3 Check the proprietor in the application corresponds with the registered proprietor

1.1.4 Check any charges in the application correspond with the registered charges

1.1.5 Check the burdens agree with the registered burdens. If the burdens differ and the application falls within a research area, the research area instructions should be followed. There may be instances where a one off burdens deed affects a property within a research area and consideration will need to be given to adding this to the burdens section of the title sheet.

Any queries arising from this should be referred to a referral officer.
