Registers of Scotland (Fees) Order 2014

In terms of section 22(1)(e), it is a condition of registration that the registration fee payable for an application to register a deed or for voluntary registration must be paid on submission of the application or arrangements satisfactory to the Keeper for its payment must have been made. Section 57(3) sets the same requirement in respect of an application for an advance notice.

The fees payable in respect of applications to the Land Register, such as applications for registration of a deed or for voluntary registration, are determined by The Registers of Scotland (Fees) Order 2014, as amended by the Registers of Scotland (Fees) Amendment Order 2021 (the Fees Order). The Fees Order also makes provision for the fee arrangements for registration in other registers maintained by the Keeper and for documents and information obtained from the registers. Some minor changes were made to the Fees Order by The Land Registration etc. (Scotland) Act 2012 (Amendment and Transitional) Order 2014 (the Amendment Order) in respect of the fees for a notice of title being submitted as a deed affecting the whole or part of a registered plot. Further changes were made to the Fees Order by The Registers of Scotland (Voluntary Registration, Amendment of Fees, etc.) Order 2015 in respect of the 25% reduction in voluntary registration fees, the fee for dispositions over registered subjects for the sole purpose of evacuating a survivorship destination, and fees for documents and information obtained from the registers.

If an officer requires to consider the Fees Order itself they must also note the terms of the Amendment Orders, which can be obtained from the legislation.gov.uk website. 

Payment is usually either tendered by cheque or the applicant's agent will use the direct debit arrangements.

The Keeper is empowered under the Fees Order to make limited variation to registration or other fees, though no determination to do so has been made.
