Notice of Payment of Grant or Loan - Housing (Scotland) Act 2006 - Example Deeds

General 

A notice of payment of grant or loan is registrable by virtue of section 84(1) of the Housing (Scotland) Act 2006.

Notices may be done by a Scottish local authority and the applicant should be the local authority specified in the notice.

 

Examples

Minimum required content of notice

There is no statutory style provided in the 2006 Act; in addition to meeting the execution requirements and description requirements for dealings with a registered title, certain other minimum content is required. The notice must include:

(1) reference to section of the 2006 Act containing the conditions which must be complied with in relation to the land or buildings affected,

(2) the period for which the conditions are to be complied with,

(3) specification of the provisions under which, if the conditions in the notice are breached, the owner becomes liable to repay the amount of the grant or loan as calculated in terms of the provisions of the 2006 Act.

Example Notice of Payment of Grant under section 71 of the Housing (Scotland) Act 2006

PART I

  1. This Notice confirms that FIFE COUNCIL constituted in terms of the Local Government etc. (Scotland) Act 1994 and having their principal offices at Fife House, North Street, Glenrothes, Fife (the appropriate local authority under the Act) has paid an improvement grant of FIVE THOUSAND ONE HUNDRED AND THIRTY FOUR POUNDS (£5,134.00) STERLING to KATHERINE ANDERSON and JAMES WILLIAM ANDERSON, both residing at Thirty One Acacia Avenue, Rosyth, Dunfermline in respect of works carried out on the house described in Part II of this Notice in accordance with the provisions of the Housing (Scotland) Act 2006 ("the Act").
  2. In accordance with section 83 of the Act, the following conditions must be observed with respect to the said house for the period of 10 years from the Eleventh day of October Two Thousand and Fourteen:

(a) the house must be used as a private dwelling; but...

(b) the house must not be occupied...

(c) the owner of the house must take all practicable steps...

(d) the owner of the house must...

3. (a) In accordance with section 86 of the Act in the event of the breach...

(b) If the local authority is satisfied...

(c) If the breach is remedied...

(d) If the authority considers that...

(e) The local authority may apply...

 

PART II

All and WHOLE Thirty One Acacia Avenue, Rosyth, Dunfermline being the whole subjects registered in the Land Register of Scotland under Title Number FFE55555.
