General

This page provides a list of the known registrable deeds, their authorising enactments and the feeing arrangements under the Registers of Scotland Fees Order 2014. For guidance on applications where the deed or document submitted for registration does not appear on this list, see Requirements of Registrable Deeds.

The list below is not exhaustive and there may be deeds in other enactments that have not been identified, for example a private or local act.

This list does not include applications to the Land Register which do not relate to registrable deeds, such as advance notices or caveats. 

Rejections for deed not being a registrable deed

A registration officer should not reject an application merely because the deed submitted for registration does not appear on the list of known registrable deeds on this page or does not have a deed code allocated in RoS systems. They should consider the guidance at Requirements of Registrable Deeds and if the deed is not referred to on that page, refer their application to a senior caseworker.

eFin categorisation

The eFinancials system (eFin) requires that when creating the finance record (the UID) for a particular application, the registration officer categorises that application type into one of three, A, B and C. The A Category is mainly for conveyances, such as disposition, contract of excambion, lease and assignation of lease as well as for an application for voluntary registration. Category B is for most other deed types or application types, the most common of which are heritable securities and discharges or deeds of restriction of heritable securities. Category C will now be used for voluntary registrations, and for advance notices, discharges of advance notices or more rarely for a registrable deed, Receipt under the Co-operative and Community Benefit Societies Act 2014 which has no fee for registration.

Decree of Reduction of voidable deed392£80 per title sheet (B)Conveyancing (S) Act 1924 s46ACertain deeds have their normal effect on registration, but are liable to be reduced (that is rendered ineffective at a later date) by a decree of court, for example, where the deed was granted in breach of an inhibition or other entry in the Register of inhibitions with inhibitory effect. Another example would be where the deed, being a disposition, was granted in advance of the granter's sequestration and was granted for no consideration, it may be liable to reduction on the basis that it is a gratuitous alienation or a fraudulent preference. The court order can now be registered where the deed affected was registered.

The deed narrates all of the conditions that apply to the whole area. This prevents lengthy repetitions of all the conditions every time a plot is sold off. Similar in effect to a deed of conditions, a deed of real burdens was a new type of deed that came into effect with the Title Conditions (Scotland) Act 2003.

Conveyancing (Scotland) Act 1924 s4A (inserted by s53 of 2012 Act)Where a person hold unregistered title to a plot of land or right in land by virtue of a midcouple (that is an unregistrable conveyance of land or a right in land) they may complete their title using a notice of title. See Notice of Title - Example Deeds. For example, when Angus District Council ceased to exist and Angus Council was created, the legislation making provision for such changes provided that property of the District Council became the property of Angus Council. The legislation is called a midcouple or link in title. A Solicitor or Notary Public can draw up a Notice of Title to confer title to Angus Council. The links in title to the property of a deceased person could include confirmation of their executors, a docket transfer in favour of a beneficiary by the executor(s) or the deceased person's will.
