Composition of The Land Register

General

The Land Registration etc. (Scotland) Act 2012 reforms and restates the law on registration of rights to land in Scotland.

Section 1 of the Act provides that there continue to be a register of rights in land in Scotland known as the Land Register of Scotland. Section 2 of the Act specifies the component parts of the register.

Parts of the Register

The register comprises:

    1. the title sheet record,
    2. the cadastral map,
    3. the archive record, and
    4. the application record.

The title sheet record

The title sheet record is the totality of all title sheets and the Keeper must make up and maintain a title sheet for each registered plot of land, including separate legal tenements. The Keeper may also make up and maintain a title sheet for a registered lease.

A title sheet will comprise:

    1. a property section,
    2. a proprietorship section,
    3. a securities section, and
    4. a burdens section.

The cadastral map

The cadastral map is a map:

    1. showing the totality of registered geospatial data, (other than supplementary data in individual title sheets),
    2. showing for each cadastral unit:
      1. the cadastral unit number, 
      2. the boundaries of the unit, and
      3. the title number of any registered leases relating to the unit, and
    3. otherwise depicting registered rights in such manner as the Keeper considers appropriate.

The cadastral unit represents a single registered plot of land and this will directly correspond with a title sheet, subject to certain exceptions (e.g. areas in shared ownership that had previously been included in separate title sheets, flats in tenements etc.).

The archive record

The archive record is to consist of:

    1. copies of all documents submitted to the Keeper, 
    2. copies of all documents which the Keeper is required to include under land register rules, and
    3. copies of such other documents as the Keeper considers appropriate.

Section 104 of the Act places responsibilities on the Keeper to provide extracts of parts of the register. The archive record must contain sufficient information to enable these requirements to be complied with. See also further guidance on the archive record.

The application record

The application record comprises, at the point in time, all pending applications for registration and all extant advance notices.
