General Updates to the Title Sheet - Rectifications

In addition to the specific updates required to the title sheet in relation to the rectification, the following updates should be made where necessary by legal staff to ensure that the title sheet is 2012 Act compliant.


 General Updates - All Rectifications
The following amendments should be made to all title sheets, if necessary, as part of the rectification process.

Proprietorship Section

  • If not already populated, complete the proprietor 'type' field (P = person, C = Company, O = Other).

  • If the proprietor is a non-natural person add the company number and legal system if information provided.

  • Delete existing MHA/CPA notes. Refer to a senior officer if additional notes exist. 

Securities Section

  • Delete any time-bound charges outwith their effective date.

  • Remove Charge Certificate Notes and Schedules (if any). Refer to a senior officer if any additional notes or floating charges/debentures exist.

Property Section

  • Update the 'TS update' date to the date the title sheet is being updated to.

- If there is a live application over the title which precedes the date of the need for rectification being established, refer to Rectifications SCW.

- If there is no live application over the title which precedes the date of the need for rectification being established, update the title sheet date to the date of the rectification application.

  • Check that the real right field is correct or amend as necessary. 

- If the real right field says ownership or tenancy, no amendment is necessary.

- If the real right field says proprietor, change to ownership or if it says tenant change to tenancy

- In the event that the real right field contains a different entry for example a mixed feudal/absolute ownership title or it is an old feudal title habile to include mineral interests, refer to a senior officer.

Burdens Section

  • No change should be made unless the rectification specifically changes an entry.

Miscellaneous Updates

  • Delete any redundant NANs.
