Process Steps

Additional Information

If the Grand Parent title sheet is not 2012 Act compliant, update as follows:

2.1 If there is a pending DW over the parent title, this can be used to give effect to the Grand Parent title update.


 2.2 If there is no pending DW, create a title update (TU) application.

1) Open the appropriate county using INTAKE ENTER function on LRS.

2) Click on Create on the LRS Case Work Desk.

3) Select Application Type TU from the dropdown list and enter the PT title number.

4) Check the address details and OK.

5) Take a note of the TU application number.

6) Open the TU application and add the following application workdesk N&I:

'TU application created to update Parent Title'

7) Release the TU application to LEGAL SETTLE.

8) Open the appropriate county using LEGAL SETTLE function on LRS.

9) Take on the TU application on LRS.

10) Print the TU flysheet and place in a separate casebag tied to the TP undergoing registration.

2.2.1 If there is a registered version of the title the TU will be created automatically using the registered version.

2.2.2 If there is no registered version for the title the TU will be created automatically using the latest draft version.

2.3 Give effect to any amendments to the Grand Parent title required as a result of any DW(s) over the Grand Parent title by reference to the Legal Settle - Complex Dealing process.




Amend Grand Parent title sheet proprietorship section


3.1 Give effect to any changes to the proprietorship section specifically required as a result of DW(s) over PT following the steps detailed in the Update Proprietorship Section - Complex DW process, if applicable.

3.1.1 Complete ROI and consider the effect of any Advance Notices on the GPT deed under examination, following the steps detailed in the Update Proprietorship Section - Complex DW process.

3.2 Check the proprietors designation and formatting of entry and amend if new detail is included in any of the deeds under examination, in the latest settled TP or in the application form.

3.2.1 Check the 'type' field is correct (P = person, C = Company, O = Other) or add/amend as necessary.

3.3 If the proprietor is a non-natural person (e.g. a company) check the following are included in the proprietor entry:

  • the legal system under which the proprietor is incorporated or otherwise established, and
  • the company number if allocated in terms of Companies Act, and
  • any other identifier (whether or not a number) peculiar to the proprietor.

3.4 Amend the consideration field to read "……..in respect of the subjects in this Title and other subjects"

3.5 Consider appropriate action for any existing exclusion of indemnity, limitation or exclusion of warranty or caveat.

3.6 Remove any MHA/CPA notes and consider action if additional notes exist.




Amend Grand Parent title sheet securities section


4.1 Give effect to any changes to the securities section required as a result of DW(s) over GPT following the steps detailed in the Update Securities Section - Complex DW process, if applicable.

4.2 Amend the entry(s) to read "……………over the subjects in this Title and other subjects", if appropriate

4.3 Delete any time-bound entries outwith their effective date.

4.4 Consider appropriate action for any existing exclusion of indemnity, limitation or exclusion of warranty or caveat.




Amend Grand Parent title sheet burdens section


5.1 Give effect to any changes required to the burdens section as a result of DW(s) over GPT following the steps detailed in the Update Burdens Section - Complex DW process. Refer to guidance on dual registration of real burdens and servitudes, if necessary.

5.2 Delete any burdens entries outwith their effective date.

5.3 Amend the burdens entries, if necessary:

5.3.1 Change reference(s) from 'the title plan' to 'the cadastral map'.

5.3.2 If an existing SPL/Supplementary plan is incorporated into the title sheet, amend the existing footnote to the burdens entry.

5.3.3 If an entry has been updated add an element note to reflect the entry complies with 2012 Act terminology.

5.4 Check TCA burdens note is the final entry, if applicable.




Amend Grand Parent title sheet property section


6.1 Give effect to any changes to the property section required as a result of DW(s) over GPT following the steps detailed in the Update Property Section - Complex DW process, if applicable. Refer to guidance on dual registration of real burdens and servitudes, if necessary.

6.2 Check that the real right field is correct or amend as necessary.

6.2.1 If the real right field says ownership or tenancy, no amendment is necessary

6.2.2 If the real right field says proprietor change to ownership or if it says tenant, change to tenancy

6.2.3 Consider appropriate action in the event that the real right field contains a different entry for example a mixed feudal/absolute ownership title or it is an old feudal title habile to include mineral interests - see Mines and Minerals - Transfer of Part.

6.3 Amend the title sheet update field as appropriate to the date of registration of the last registered DW/TP currently being completed, as appropriate.

6.4 If any of the deeds under examination contain new address details for the Grand Parent title subjects, add a note to plans on the title workdesk.

6.4.1 Check the property description includes the cadastral unit number and, if a positive mapping style has been used, the hectarage to 2 decimal places if 0.5 hectares or greater than 0.5 hectares.

6.4.2 If the property description does not include the cadastral unit number and, if applicable, the hectarage, update the property description to include the cadastral unit number and hectarage as instructed by plans.

6.4.3 If plans have not provided instructions, add a note to plans on the title workdesk to update the GPT property description.

6.5 If a positive mapping style has not been used, give effect to removal(s) from GPT by adding to existing notes and schedule(s) or creating new notes and schedule(s):

6.5.1 Make a note of any removals for prior flatted properties within the tenement steading (if any): these will need to be added to the new tenement PT schedule of removals

6.5.2 Check the schedule entries are correct and are in date order and amend if necessary.

For the avoidance of doubt, where the parent title shows that exclusive rights of use of, for example, car parking spaces have been removed from the parent title following 1979 Act procedures, the plans references on the cadastral map and the existing removal note in the property section relating to the exclusive rights of use should be retained. The removal note should be amended to be 2012 compliant to read, for example, "The exclusive rights of use of the car parking spaces edged and numbered in mauve on the cadastral map have been removed from this title."

6.6 Add a schedule of subsisting rights to real burdens and a cross reference to the schedule in the suffix of the property description or add an entry to the existing schedule for post appointed day deed, if applicable.

6.7 If the rights include a servitude which has been shown in full in the property description, add note specifying the deed in which the servitude right was created or that it is a prescriptive servitude.

6.7.1 If the servitude right has been included in the property description by way of cross reference to a deed in the burdens section, no note is required.

6.8 Check a TCA property section note is included, if applicable.

6.9 Add note cross referring to burdens section if required.

6.10 Amend any reference from 'Title Plan' and 'Supplementary Plan' to 'cadastral map' and 'supplementary data to the title sheet'.

6.10.1 If there is an existing boundary table, change the wording in the heading from 'Title Plan' to 'cadastral map' (e.g. 'The boundary between the points indicated on the cadastral map').

6.11 If any amendments are required to the cadastral map or to the address details check a note to plans has been added to the title workdesk and refer to plans.
