Plans Information Paper 4/2014: Identification of Index Files affecting an Application for Registration

Plans settlers are reminded that as part of the Index Map check carried out against each application for registration, all information identified from the Index Layer as affecting the application must be noted in the Title N&I on the LRS. This could be information relating to existing registered titles, Research Area(s) (RAs), Tree Preservation Orders (TPOs) etc.

It is stressed that where multiple indexes are identified from the Index layer as affecting any part of the application, these should all be listed in the Title N&I. You may, for example, have both an RA and a TPO affecting, in which case both should be listed.

The 'Notes to Legal' template, from the drop down menu, should be used so that the presentation of this information to the legal settler is standardised. This will also ensure that nothing is omitted as all sections should be completed or deleted as required.

By ensuring that all relevant information is supplied to the legal settler, the legal settler will be better placed when considering which information requires to be included in the Title Sheet.
