S18.3 The Keeper's Role
Section 79(1) of the Act provides that:
" A land transaction to which this section applies or (as the case may be) a document effecting or evidencing a land transaction to which this section applies, shall not be registered, recorded or otherwise reflected in an entry made – in Scotland, in any register maintained by the Keeper of the Registers of Scotland unless there is produced, together with the relevant application, a certificate as to compliance with the requirements of the Part in relation to the transaction"
Accordingly the Keeper can only accept a deed for recording if it is accompanied by the appropriate certificate. It is emphasised that Sasine Intake staff will examine each deed to determine whether it should be accompanied by a certificate. If the application requires a certificate and no certificate has been submitted the deed will be rejected.
