S17.26 Contracts of Excambion

When two parties agree to exchange properties or parts of their properties the resultant legal transaction is known as an "excambion". This is usually effected by a bilateral Contract of Excambion. As this induces registration in the Land Register, these deeds are much less common in the Sasine Register but can be recorded if subjects in Sasines are affected by real burdens or servitudes contained in the deed.
