S6.1 Execution

S6.1 Execution

"In the Conveyance of an immoveable subject, or of any right affecting heritage, the granter must follow the solemnities established by the law, not of the country where he signs the deed, but of the state in which the heritage lies and from which it is impossible to remove it" (Erskine's Institutes).

Execution is the term used in relation to the signing and witnessing of a deed. In 1995, a significant piece of legislation made considerable changes to the form of execution and the requirements of formal writings.
