S4.2 Boundaries in Breakaways

A FIRST CLASS boundary is a named road, street, avenue, etc. or a postal address which includes a named street:
e.g. Smith Street, Larch Gardens or 12 Wilson Avenue.

A SECOND CLASS boundary is an un-named road or street:
e.g. bounded by “a road” or “the road from A to B”.

Boundaries are minuted as follows:

All first and second class boundaries are minuted, even if the first class boundary has the same name as the postal address. The direction of boundaries is shown:
e.g. ground, with house 1 LINGERWOOD STREET, NEWTONGRANGE thereon, bounded on west by said street, on north by MILTON ROAD and on east by a road, part of.....

Notes

i) - Where the deed states “bounded on the west by the centre line of Panbride Road...” this is minuted simply as “bounded on west by PANBRIDE ROAD....”

ii) - Where the deed states “bounded on the north by the heel of the footpath separating the subjects hereby disponed from the road known as Cramond Green” this is minuted as “bounded on the north by CRAMOND GREEN”.

iii) - Where the deed states “bounded on the east by the centre line of a fence separating the subjects disponed from the adjoining subjects plot 12 Murray Avenue” this would be minuted since the subjects disponed only share this boundary with the next door plot.

All boundaries should be checked against any plan which is included in the deed. Check the directions, extents and colours are correct. Where the deed states subjects are bounded by a particular street or a plot or house number check that this information is also correct. These details should be noted on the rubric as concisely as possible.
