S2.8 Main Considerations in Minuting

Minuting comprises the framing of the entry to be made in the Minute Book, stating concisely the contents of each writ – generally the parties, the description of the subjects and the date. From the Minute Book a searcher can, with the aid of the Indexes compiled each year, prepare a search for Incumbrances over any particular property, which will disclose all the entries affecting that particular property during the period of search. The whole system of registration and of property transactions in Scotland thus depends on the accuracy, completeness and clarity of the minute.

The main considerations in minuting are to reflect the deed accurately, whilst giving the best possible description of the subjects in a standard form and coding relevant items for inclusion in the Minute Book indexes.
