New Page - Complex Dealings

A new page, titled Complex Dealings, has been added to the Further Guidance section of the registration manual. It covers a broad range of topics which are often encountered when settling complex DWs.

Instructions for legal examination of voluntary registrations have been updated as follows:

There is no ROI question on the VR form. If the applicant certifies on VR form that a search has been done to identify heritable securities to the date of the ROI, the registration officer must carry out a full 40 year search of the Register of Sasines to identify any apparently extant heritable securities and compare any apparently outstanding securities with any discharge(s) submitted for registration subsequent to the voluntary registration application. If the VR application is submitted with a dealing or other application, the registration officer should disregard/ not consider the ROI question in the dealing or other application form when deciding to search the sasine register for standard securities.

In preparation for the closure of the DMS & its database, the migration of DMS titles into the new CadMap database has begun. Migrated titles must not be re-opened in the DMS and can only be worked on in the new mapping tools. A short guidance page Migration of DMS titles into Cadastral Map database has been added to the manal giving details of which titles have been migrated so far and how to identify them.
