Does the deed submitted comply with the following?

  • The deed is executed appropriately

  • Where the deed was made prior to May 1995, execution includes at least two witnesses

  • Where the deed has been executed outside of Scotland, written confirmation has been provided as proof of legal validity within that country

  • Where the deed is a Will, each page has been signed by the testator (unless executed outside Scotland)

  • Where the deed contains a conditional time-frame, this has been met by the accepting agent

  • Where the deed is also being registered in the Land Register it complies with the relevant registration requirements

Note for digital submissions the deed may be submitted separately as a QES (Qualified Electronic Signature) file for a digitally signed document and as a WET (Wet Signed Signature) file for an ink signed document.
