Half Roadway
Where an application for registration describes the property as including the half roadway, the cadastral unit should be mapped to include the half roadway. In other words, the cadastral unit should be mapped to the full legal extent as the ground forming the half roadway cannot be included verbally in the title sheet.
Where the roadway has been widened or re-aligned, the plotting of the half roadway should be based on the roadway as it was defined at the time that the deed for extent was recorded or registered.
The plans settler should only provide a separate reference on the cadastral map for the area comprising the half roadway if the deed inducing registration or the deed for extent contains specific burdens relating to that area. The legal settler may, of course, request that a plans reference be provided once they have legally examined the application.
