S14.16 Local Authority and Housing Association Dispositions Decision tree (where application submitted for Dual Registration)
1. Does the deed contain real burdens?
Yes - go to step 2.
No - go to step 3.
2. Does the deed nominate and identify the subjects that have the right to enforce the real burdens?
Yes - draft as per instructions in s.14.14.
No - refer to Sasine RO1 referral officer.
3. Does the deed contain servitudes?
Yes - draft as per instructions in s.14.14.
No - if deed contains real burdens only, draft as per steps 1 and 2.
4. Are the subjects affected by the servitude/ real burdens still in the Sasine Register?
Yes - The Sasine minute should be entered on the Search Sheet/s for the affected subjects.
No (subjects are already in Land Register) - refer to Sasine RO1 referral officer.
5. If the deed appears to contain neither real burdens nor servitudes, refer to Sasine RO1 referral officer
