General

When a title contains several plots of land that are separated by a distance that will make the cadastral map extract be over multiple pages when printed, consideration should be given to splitting the plots into two or more titles. Section 13 (2) (c) of the 2012 Act allows the Keeper to split titles in certain circumstances, however the decision to split must be approved by a Plans HEO, who can escalate to an SEO if there is any doubt on the most appropriate course of action.


Multi-part plans

If the decision is not to split the property into multiple titles, the Groupings functionality within the Plans Creator can be used to create multi-part extracts from the cadastral map and thus make the title more manageable to print or view as a separate PDF plan extract will be automatically generated for each group.

The first of the disparate parts of the title will remain "ungrouped" and will be mapped on the primary cadastral map layer; the remaining disparate parts can then be mapped in one or more secondary groupings effectively putting them on additional layers of the cadastral map.

Previously, in the DMS, a similar result was achieved using the /wiki/spaces/2ARM/pages/65143097 - this had several draw-backs, however, including the need to re-set the multi-part prints every time there was a new application affecting the title. By achieving the multi-part end result through the use of groupings, we now create a more manageable title that does not need such regular re-working.


Terminology to be used in the title sheet

For the part(s) of the subjects on the ungrouped primary layer, these will be described in the property section as being "on the cadastral map".

Until some further technical development is undertaken, the additional PDF plans created for each group will still be labelled in the plan header as "Supplementary Plan to the Title". In the multi-part plan scenario, these additional groups or layers are not actually showing supplementary data to the title, but are being used to show title detail that is part of the cadastral unit. Therefore, the part(s) of the subjects on the grouped additional layers, will currently be described in the property section as if they are secondary layers of the cadastral map, referring to them being "on the secondary layer to the cadastral map of which an extract is included as supplementary data to the title sheet".

In a particularly complex title where more than one grouping is required to show the various parts of the title, the extracts associated with each grouping should be referred to in the title sheet as being:

...on the secondary layer of the cadastral map of which an extract is included as supplementary data 1 to the title sheet

...on the secondary layer of the cadastral map of which an extract is included as supplementary data 2 to the title sheet", etc.


Note to Legal

The plans officer should add an LRS title note to inform the legal settler that the plans references shown in the grouping(s) are not supplementary data but part of the cadastral unit. This is so that the legal officer will know to edit in any reference to burdens or rights as being on a layer of the cadastral map, and not on supplementary data.

  • For example, Legal Examiner, please ensure that any references in the title sheet that are depicted on the group ABN12345-1 should be referred to as "tinted/hatched/edged xxx on the secondary layer of the cadastral map of which an extract is included as supplementary data 1 to the title sheet.".
