L49 Fees
49.1 Fees for Land Register Applications
RoS operates a system of Pre-payment of fees for all Land Register applications except Form 5 or Form 9 applications.
As a consequence of pre-payment arrangements, registration officers are not involved in collecting or checking fees, as this task is completed at the Create stage. Further, RoS policy is that registration officers are not required to check that the appropriate fee has been paid.
The following information is therefore primarily of relevance to Create officers, and for other registration officers as a source of reference not instruction. Customer enquiries regarding fees should be directed to Customer Services.
Registration fees are governed by the Fees in the Registers of Scotland Order 1995, which came into operation on 1 September 1995. The 1995 Order was amended by Amendment Orders in 1999, 2001, 2004, 2005, 2006, 2009 and, most recently, by the Fees in the Register of Scotland Amendment Order 2010 (SSI 2010/404).
The 2010 Order came into force on Monday 10th January 2011. Details of changes to Fees arising from the Order are given in RoS' publication 'A Guide to Fees'.
A summary of changes to registration and recording fees made by the 2010 Order is provided in 'Registers Update 30'.
Full details of the fees brought into force on 10th January 2011 by the 'Fees in the Registers of Scotland Amendment Order 2010' are provided in RoS' 'Information Fees and Fees for the Land Register and the General Register of Sasines' guide that accompanied Registers Update 30.
