Petitions for the making of an Administration Order under the Insolvency Act 1986
While no answers require to be lodged, two possible courses of action exist where CAJR is in receipt of such a Petition:
i) Where a citation is accompanied by a Notice of Petition for Administration Order (Form 2.2B (Scot) under Rule 2.3 of the Insolvency (Scotland) Rules 1986):
- CAJR should register said Notice immediately.
- CAJR should then note on the Notice that it has been registered before passing said Notice to the Litigation Team in Legal Services where it will be filed in their miscellaneous file A15/7.
- No further action is required by CAJR.
ii) Where the citation is not accompanied by a Notice of Petition for Administration Order:
- CAJR should contact the submitting Agent in order to ascertain whether a Notice is to be lodged.
- If a Notice is to be lodged, the steps above should be followed upon receipt thereof.
- If a Notice is not to be lodged, CAJR must note, in pencil, this fact on the Citation ('No Notice to be lodged') and pass it to the Litigation Team in Legal Services for filing in their Miscellaneous file A15/7.
- No further action is required by CAJR.
