Converting a Shared Plot Title Sheet to an Ordinary Plot Title Sheet

In terms of section 17(1)(a) of the 2012 Act a plot of land can be designated a shared plot where the plot of land is owned in common and where the ownership of the plot is by virtue of the ownership of other plots of land (i.e. it is a pertinent to those other plots of land). Where a plot has been designated a shared plot but is no longer owned in common, or where a share of ownership in the shared plot is being transferred and the share in the shared plot will not be a pertinent to a registered plot of ground the requirements of section 17 have not been met and the shared plot will no longer be designated a shared plot and must be converted to an ordinary plot.

Example 1

Title numbers MID1, MID2 and MID3 (the sharing plots) each have a 1/3 share in shared plot title MID4.

MID1 and MID2 each convey their 1/3 share in MID4 to the proprietor of MID3.

The shared plot is no longer owned in common.

Example 2

Title numbers MID1, MID2 and MID3 each have a 1/3 share in shared plot title MID4.

The proprietor of MID1 conveys their 1/3 share in MID4 to the proprietor of 16 Main Street, Edinburgh. 16 Main Street is an unregistered plot in the sasine register and is not undergoing registration.

The share is not being transferred to a registered plot as a pertinent to that plot.

Example 3

Title numbers MID1 and MID3 each have a 1/2 share in shared plot title MID2.

MID1 is to be amalgamated into MID3.

The shared plot is no longer owned in common.
