Converting a Shared Plot Title Sheet into an Ordinary Title Sheet - Legal Settle

The following process should be used when i) a shared plot is no longer owned in common, ii) the ownership of a share in a shared plot is being transferred but is not being linked to a registered plot as a pertinent to that plot.

Process

1.1 Take on the lead application on LRS.

1.1.1 Any other linked applications will also be automatically added to the LRS case workdesk.

1.2 Complete an application record search for each of the sharing plots and identify if there are any pending applications.

1.2.1 If there are any pending applications consider whether the applications must be completed before proceeding.

1.3 Complete an application record search for the shared plot title and identify if there are any pending applications.

1.3.1 If there are any pending applications with a date of registration prior to the deed undergoing registration ensure the applications are completed before proceeding.

1.4 Open the application for each sharing plot application and view a version of the title sheet and check the property section does not contain an entry for the shared plot title or, if applicable, a shared plot schedule.

1.4.1 If the sharing plot title had a relationship with one shared plot title the property section should not contain a shared plot schedule.

1.4.2 If the sharing plot title had a relationship with more than one shared plot title and the other shared plot titles are not being converted to ordinary titles the property section should contain a shared plot schedule but should not contain an entry for the shared plot title that is being converted.

1.4.3 Refer to plans if the property section contains an entry for the shared plot title being converted.

1.5 Open the application for the shared plot title and view a version of the title sheet and check the proprietorship section does not contain a sharing plot schedule.

1.5.1 Refer to plans if the proprietorship section contains a sharing plot schedule.

1.6 Examine the title sheet for each of the sharing plot titles and print if necessary.

1.7 In the proprietorship section of the shared plot title sheet add the proprietor details including the full designation.

1.7.1 Where the plot is no longer owned in common a single entry will be required.

1.7.3 Where the plot is still owned in common an entry will be required for each proprietor together with the extent of their share of ownership.

1.7.4 Add any proprietorship section notes, if applicable.

1.8 In the securities section of the shared plot title sheet add any existing entries, and add any new entries required in respect of the deed undergoing registration.

1.8.1 The designation of the granter may need to be added to each entry.

1.8.2 Where the plot is still owned in common any existing entries from the securities section of each of the sharing plot titles may require to be brought forward and each entry should indicate the extent of the share affected.

1.9 In the burdens section of the shared plot title sheet add any existing entries, and add any new entries required in respect of the deed undergoing registration.

1.9.1 Where the plot is still owned in common any existing entries from the burdens section of each of the sharing plot titles may require to be brought forward and edited as necessary.

1.10 In the property section of the shared plot title add any schedules and notes, if applicable, and update the property section as required in respect of the deed undergoing registration.

1.11 Consider any amendments required to each of the sharing plot titles.

1.11.1 If any existing entries in the securities section of the sharing plot title sheet are being added to the shared plot title sheet update the entry in the sharing plot title sheet to include the text 'over the subjects in this title and other subjects.'

1.11.2 Update the title sheet update date.

1.12 View, confirm and complete each application as normal.

1.12.1 Each title must be confirmed separately and the print master title sheet function must be completed for each title.

1.13 The shared plot title sheet is now an ordinary plot title sheet.

1.14 Any sharing plots are no longer sharing plots and are now ordinary plots.
