5.9 Use of Trade or Brand Names

The use of trade or brand names should be avoided as this too could serve to limit the number of potential suppliers and stifle competition. The use of trade or brand names could also be a breach of the EU Procurement Directives. If the use of such a name cannot be avoided then the words 'OR EQUIVALENT' must be inserted alongside together with a specification of the product. Certain artistic commissions, works of art and literary works are exempted from this regulation. The preferred method of approach is the use of generic descriptions and if appropriate, the EU Standard(s) should be quoted. If EU Standards have not been established then the use of another (e.g. British Standard) is permissible providing that the words 'OR EQUIVALENT' have been inserted alongside.
