Notices of Potential Liability for Costs relate to an owner's liability to contribute to certain costs such as common repairs or a common insurance premium. These notices will either refer to (i) the Tenements (Scotland) Act 2004 or (ii) the Title Conditions (Scotland) Act 2003.

Check the deed

1.1 Ensure the deed contains the correct title number and postal address of the subjects. If not, refer to your referral point.

1.2 Check the property section of the title sheet to establish if the subjects form a flat or a house.

1.3 If the subjects form a flat in a tenement, a four-in-a-block or a sub-divided detached property, the deed can refer to either Act.

1.4 If the subjects form a terraced, semi-detached or detached property the deed should refer to the Title Conditions (Scotland) Act 2003. If it does not, refer the application to your referral point.

1.5 In every case the deed should be in, as near as may be, the style shown in the these Examples.

1.6 You should refer any notice that differs significantly from the given styles.

1.7 Ensure the deed is correctly signed and witnessed. If not, refer to your referral point.
