Tenements - KIR (Public)

The guidance on the following pages is intended to cover the most common scenarios. If you encounter a scenario for which there is no guidance, refer the application to a senior caseworker.

Where the RA includes 4 in a block or other flatted properties the extent of the KIR title will vary depending on circumstances. Sometimes the tenement steading will be excepted from the main/original KIR title (and a separate KIR title created for the tenement steading), sometimes the tenement steading will be retained within the main/original KIR title. The plans officer will advise.

The usual practice for describing the subjects in each KIR title is to only include the addresses of properties that are owned by the council. In some cases involving tenements, the description of flats being excepted from the KIR title is such that they cannot be matched to a UPRN address (e.g. the UPRN address is 0/1, 3 Main Street but "0/1" is not included in the description of the excepted property in its title sheet/breakaway deed). In these circumstances, the affected tenement will be assigned a separate cadastral unit and KIR title. The description of the subjects in this separate KIR title will include every address in the tenement. The plans officer will have added an explanatory title note.
