Paper Advance Notice over Whole

ANs over whole will generally be submitted electronically. The process below should be followed in the event that the AN is completed on a PDF and submitted on paper.

Examine advance notice to ensure it is acceptable for registration

 

1.1 Check Advance Notice (AN) application form to ensure it is an AN over whole.

 

1.2 To ensure the advance notice meets the statutory requirements of registration, check that:

  • The advance notice application states that a person intends to grant a deed.
  • The parties are named and designed.
  • The type of deed to be protected is stated.
  • The title number of the title sheet to which the deed is to relate is stated, or where the deed is related to a registered lease which does not have a lease title sheet, stating the particulars of the lease.

1.3 If payment is by cheque ensure that:

  • It is made out to Registers of Scotland/RoS/the Keeper/Land Register of Scotland/Scottish Land Registry.
  • It is signed, dated and covers the exact fee
  • The amount in words must also match the amount in numbers.
  • The fee for an AN is £10. A separate cheque is required for each AN and it must be for the correct amount. No refunds will be issued and the AN should be rejected if the cheque is not for the correct amount.
  • It is presented by the agent submitting the AN application. If it is not the same agent on the AN form, it should be rejected.
  • It is not post-dated or is dated more than 6 months ago.

This is the stop point if any of the statutory requirements of registration or the payment requirements have not been met then the application must be rejected.

AN handling system

 

1.4 Log into AN handling system through the eServices portal using the permissions for paper ANs.

1.5 Check the box to “Apply for an Advance Notice on behalf of Somebody Else” and enter the details from the AN form as follows.

Special permissions are required to be able to apply for an advance notice on behalf of someone else. If the check box does not appear on the first screen refer to team leader.

1.6 Complete the deed type and whether the subjects are registered in the Land register.

1.7 Enter the 'Notice over' application type, the County and the Title Number.

1.7.1 If the title number is for a shared plot a warning message will appear. Refer to a senior officer to consider if it is appropriate to proceed.

1.8 Enter the Granter(s) details and then the Grantee(s) details and ensure all the mandatory fields are completed.

1.9 In the Agent Details select the payment method and enter the FAS number, the Firm name, address details and Telephone number.

1.9.1 Where the applicant is an individual who is acting without a solicitor and has no FAS number enter 8888. This will automatically populate the Firm name field with PERSONAL PRESENTMENT. 

Special permissions are required to be able to apply for an advance notice on behalf of an individual who is acting without a solicitor. If the Firm name does not automatically populate with PERSONAL PRESENTMENT refer to team leader.

1.10 On the Agent emails screen, enter your own email address to obtain confirmation that the AN has been submitted.

1.11 In the Confirm screen check all the details are correct and Confirm and submit or edit as necessary.

1.12 Return to landing page of AN handler and search the AN number to bring up the AN details.
