S14.17 Examples of deeds unaffected by the new legislation
The following types of deeds do not require to meet the provisions of the Title Conditions Act as these deeds do not create real burdens:
- Deeds registered in terms of the Town and Country Planning (Scotland) Acts, such as Tree Preservation Orders and s.50/75 Agreements.
- Leases and Assignations of Leases (unless the deed creates real burdens affecting the landlord's interest).
- Deeds registered in terms of s.32 of the Enterprise and New Town (Scotland) Act 1990.
Any such deeds presented for dual registration should be referred to a Sasines RO1 referral officer for advice on how to proceed.
