Introduction

Where an error is discovered in a writ, the decision whether or not to phone the agent must be made in the light of the circumstances. It is not possible to compile a comprehensive list of cases in which this must be done, and each deed must be viewed on its own merit.

It should be remembered that it is not for the Keeper to prescribe a solution in respect of an application to register a deed that does not fulfil the intention of the parties to it. Nor is it within the Keeper's remit to offer legal advice. We may be able to offer possible solutions, but it should always be emphasised that these are not necessarily the only solutions that can apply.  

The Sasine RO1 referral officers may be consulted regarding any such enquiries from agents. 

However, there are only very limited circumstances where we can outright refuse to record a deed.
