Salmon Fishings - Sift Instructions

Rights to fish for salmon are often very valuable. They can be bought and sold alongside a sale of the land, or they can be sold using a separate disposition.  

You must always use the “Salmon Fishing (AO Check)” case characteristic. The other characteristics may be added by a Senior Adviser once they have reviewed the application.

How will I recognise salmon fishings?

  • The description of the subjects in the disposition will include salmon fishings. The salmon fishings may be listed by themselves, or they may be included in a list of pertinents such as:
    • … the salmon and other fishings …
    • … the salmon fishings between the points marked X and Y on the plan annexed hereto …
    • … the salmon fishing in the river Braan so far as lying ex adverso the subjects hereby disponed …
    • … the whole rights parts and pertinent of the said lands and estate including the right to fish for salmon and trout …
  • In the application form, the salmon fishings should be narrated as part of the property description.
  • The salmon fishings might be narrated in the “further information” section of the application form, or in a separate covering letter.
  • Salmon fishings are often sold in pro-indiviso shares. Sometimes the pro-indiviso shares can be very irregular numbers, such as “13/67 pro-indiviso shares”.

For a mixed title (land + fishings) if the application form states “fishings” instead of “salmon fishings”, check to see what it says in the deed. The deed must specify “salmon fishings”. If it merely repeats “fishings” then the salmon fishing characteristic does not apply.

What else do I need to know?

  • Salmon fishings may be sold by themselves, or as part of a general disposition. This characteristic applies in both cases.
  • On occasion, you may come across a deed which dispones rights to trout, or more generally sporting rights. These can be ignored.
  • Very occasionally, a deed may dispone the right to gather shellfish or oysters. In this case, please add the “other” case characteristic, and add a note to the JIRA ticket.
