Rectifications - Outcome 2 - Rectify

Process Steps

Additional Information

4.1 Complete an application record search and identify if there is live application prior to the date of the need for rectification.

4.1.1 If there is no live application create a Rectification application.

When rectifying supplementary data to the title sheet/SPLs that are assigned to registered titles (for example, when rectification is required but the inaccuracy is only on the supplementary data), an RR application is still required over the title. A new version of the cadastral unit/Title Plan must be saved and authorised on the DMS, otherwise the updated version of the assigned supplementary data/SPL will not be pushed over to ScotLIS.

4.1.2 If there is a live application over the title which precedes the date of the need for rectification being established, refer to a Rectifications senior caseworker.

 Pending Live Application Identified

If a title to be rectified has an outstanding live application, reference should be made to a Rectifications senior caseworker to consider how to proceed. This may require:

1) The completion of the rectification using the live application.

2) The outstanding application to be expedited.

3) A delay to the rectification until outstanding casework is completed.

4) Consideration of the dating of the rectification of a title sheet.

4.2 Rectify the title as appropriate.

4.3 Add a brief note describing the nature of the rectification in the Application Notes and Instructions.

4.4 Consider who should be notified of the rectification and draft letters as appropriate.

4.5 Copy any enclosures to be returned to solicitor, if appropriate.

4.6 If appropriate, draft response to Registration with appropriate instructions for any live applications.

4.7 Update the Post Registration Enquiries Log.

4.8 Ensure copy of correspondence and relevant documentation are scanned with application.

4.9 Issue correspondence/response as appropriate.
