Where the same parties have recorded two or more Standard Securities over the same subjects, on the same day, it is necessary to correctly identify which Standard Security is being discharged. This can be done by introducing either the amount of the loan or the book and folio numbers/fiche and frame numbers/Yearly running numbers into the Minute (but only if that information is contained in the deed). e.g. (No. 67) 28 Aug. 2003 OR (No. 9) 11 Sep. 2003 |
Where there are two or more Standard Securities recorded on the same day to different parties e.g. one Standard Security by John Smith in favour of Nationwide Building Society and another by John Smith in favour of City of Edinburgh District Council, we must indicate in the Minute of the Discharge which Standard Security is being discharged by adding the words “to said Granter” after the debtor’s designation. e.g. (No. 7) 1 Jul. 2003 Note: An exception to this is where there is a deduction of title, as this will be minuted and refers to whom the security was granted. |
If a Discharge is discharging two or more securities then, where the wording of the deed allows, the following style should be adopted: (No. 7) 1 Jul. 2005 |
