Process Steps

6.1 Check the search sheet to ensure there are corresponding discharges/deeds of restriction for any outstanding securities/charges detailed on the Instruction Card as affecting the RA search sheet.

6.2 Enter details of any outstanding securities as disclosed on the search sheet, for which no discharge/deed of restriction has been recorded.

6.2.1 Select C on the title workdesk and click Add. This will open the C Section Amend screen.

6.2.2 Click Details.

6.2.3 The registration field will be left blank.

6.2.4 Select the appropriate standard security style from the drop-down list:

    • If the amount of the standard security is not included in search sheet information, use Style 18.
    • If the amount of the standard security is included in search sheet information, use Style 70.
    • If the amount of the standard security is included with the words "and further sums", use Style 17.

6.3 Enter the debtors information.

6.3.1 Select Import. This will open the Proprietor Names Import screen.

6.3.2 Highlight the proprietors and click Ok. The proprietors will now appear as the Debtors. 

6.4 Enter the creditor information.

6.4.1 Select Type L from the Type drop-down list.

6. 4.2 Select the appropriate creditor entry from the pick list. A number of larger lenders may have a variety of entries on the list – ensure the correct option is selected by ensuring the designation corresponds with the description narrated in the archived Sasine deed.

6.4.3 Only where there is no corresponding entry on the pick list (for example where the lender is an individual) select Type U from the Type drop-down list and enter the creditors details exactly as they appear on the search sheet entry.

Do not attempt to add any additional information about the creditor - use only the information from the search sheet.

6.4.3 Enter the recording date of the standard security in the Additional field in the following style: "DD MMM. YYYY (e.g. 25 Dec. 1984)"

6.5 Check details and click Close.

6.6 Refer to a senior officer in the following circumstances:

6.6.1 If any outstanding security is recorded over only a part of the title.

6.6.2 If there is an entry for a ranking agreement on the search sheet.

6.6.3 If there are entries on the search sheet for types of charges other than standard securities (e.g. a notice of payment of grant or a charging order). 

6.6.4 If an outstanding security states it is to secure sums under statutory provisions (e.g. crofting or right to buy legislation).

6.6.5 If there is an entry for a deed of variation of a security on the search sheet.

6.6.6 If there is an entry for an assignation of standard security on the search sheet.

6.7 Check details and click Close.

6.8 Click Apply on the title workdesk.
