Complete Burdens Section - KIR

Process Steps

8.1 The breakaway deed may contain additional burdens affecting the KIR title. Where this information is included on the Instruction Card, update the burdens section to add an entry for the breakaway deed and include the appropriate burdens detail.

8.1.1.Select D from the title workdesk and click Add. This will open the Add Deed screen.

8.1.2 Add the recording date of the breakaway deed and select GRS from the Register drop-down list. 

8.1.3 Click Ok. A list of deeds will appear which were recorded on that date for that county.

8.1.4 Add the breakaway deed to the list. Select the county from the Reg drop-down list and click New Deed.

8.1.5 Add the Daily No., Grantee, Grantor, Book/Fiche, Folio/Frame and Subject in the appropriate fields. This information will be taken from the search sheet entry for the breakaway deed.

8.1.6 Select the appropriate entry from the Common and Type drop-down lists. A breakaway deed is generally 'not common'. The deed type will be taken from the search sheet entry.

8.1.7 Enter "Breakaway Deed for (title number)" in the Element Note field.

8.1.8 Check details and click Ok. A burdens section entry for the breakaway deed has now been created.

8.2 Enter the text for the breakaway deed burdens entry. 

8.2.1 Select the model style breakaway deed. It will contain an element note stating "Version to be copied and amended for KR Apps from RA *****".

8.2.2 Click View Text. This will open a Word document.

8.2.2 Select and copy all of the text in the entry, and close the document.

8.2.3 Select the new breakaway deed entry and click Amend. This will open the Deed Amend screen.

8.2.4 Click Text. This will open a blank Word document.

8.2.5 Paste the model style breakaway deed text into the blank document.

8.2.6 Amend the preamble to include the details contained in the breakaway deed.

8.2.7 Check details and close the Word document, ensuring the work is saved, and click OK. The entry for the breakaway deed has now been completed.

8.3 Delete the breakaway deed from the model title. 

If the breakaway deed is not deleted from the model title, the KIR title will appear to have two breakaway deeds.

8.4 Check details and click Close.

8.5 Click Apply on the title workdesk.
