Standard Practice Instructions (SPI)

The purpose of the Standard Practice Instructions is to set out how to legally examine deeds for recording in the Sasine Register and to produce accurate minutes.

It also sets out procedures for drafting Confirmations and Multiple County Deeds/Joint Recordings.

Login to CSR and Draw batch

  • Take batch of writs from cupboard
  • Sign for batch in book
  • Login to CSR “draw”
  • Enter County and date to take on batch

Ensure any confirmations already completed are drawn as part of the batch

  • Close CSR
  • Login to “Drafting” on CSR

 

Verification of Search Sheet

  • Open CSS Enquiry
  • Enter Search Sheet number if noted on the backing of the writ

The Search Sheet number will not always have been noted. If not, identify the Search Sheet number, through CSR/SSI Index Search facilities. If there is no CSS for the subjects, then enter the Search Sheet number in the SSI.

  • Check that the Search Sheet is the relevant one for the subjects in the writ
  • Always check SSI for the description of the Subjects of Search and any exceptions
  • Where exceptions are narrated on the Search Sheet, check whether granters are infeft, if not, note error on rubric.

When a closing note appears on the Search Sheet for an operational County writ and search sheet has been closed, the subjects narrated in that note have been transferred to the Land Register. Subsequent writs can no longer be recorded in the Sasine Register. Withdraw writ and return to Agent.

Examination of Writ and Completion of Rubric

  • Examine the writ for the requirements of recording
  • Complete rubric at the same time, noting any error(s)

Repeat “verification of search sheet” and “examination of writ and completion of rubric” for remainder of writs in batch.

Drafting of Minute

  • Highlight writ on screen to bring forward skeleton minute 
  • Draft minute

1. Expand the skeleton minute by adding the following information taken from the writ:

Designations of parties
Consentor, if relevant
Survivorship destination, if relevant 
Description of subjects
Drafting of Minute 
Exceptions
Deduction of Title
Date of execution

2. Expand the skeleton minute by adding the following Code L information:

Consideration
Plan, if relevant
Preservation and/or Execution, if relevant
Any additional information from the backing of the writ, the SAF and search sheet which improves the property description

If an error has been identified in the writ that renders it inept, the writ will be withdrawn and returned to the Agent. Where the error does not strike at the validity of the writ, contact Agent to discuss the course of action to be taken.

  • Add Search Sheet no. to identify Subjects of Search affected by the writ or where it is the agreed course of action following contact with Agent.

CSS Instructions

  • Enter CSS number(s) and any new sheet required on CSS Instructions/Amendment screen
  • F9 to view Search Sheet
  • Where Search Sheet is not on CSS, input Book and Folio numbers from SSI
  • F10 to return to Instructions/Amendment screen and confirm Search Sheet
  • F10 to return to drafting batch

Repeat “Drafting of Minute” and “CSS Instructions for remainder of writs in batch.

Check Off of Minute

  • Proof read minute to ensure accuracy
  • Check instructions and format of CSS
  • Edit drafted minutes and CSS instruction, where necessary

Repeat for remainder of writs in batch

  • “Return” to complete batch

The batch must be completed to enable the Print Room to book in the batch and complete their duties

 

Preparation of batch for Print Room

  • Complete waybill by inserting the following:

Recording date
County
Number in batch
Writs withdrawn
Total number to Print Room

  • Separate SAFs, rubrics and writs and re-assemble batch
  • Place batch in cupboard
