S4.3 Extents in Breakaways
SQUARE MEASUREMENTS
A square measurement refers to the extent of the area of ground being sold e.g. 140 square metres.
Square measurements are always minuted. When minuting a square measurement, do not include the phrase “of ground”.
LINEAR EXTENTS
A linear extent is the extent along a boundary. Linear extents are never minuted.
e.g. writ: house 44 Shields Road, Dalkeith, bounded on north by and extending 10 metres along said Road, part of.....
would be minuted as house 44 SHIELDS ROAD, DALKEITH, bounded on north by said Road, part of....
SOLUM
Solum is the Latin term for the ground on which the building is erected. It is minuted only where it appears in a deed as a square extent.
e.g. breakaway deed - “ALL and WHOLE the dwelling house known as 44 Shields Road, Dalkeith with the solum thereof and the ground attached extending to 160 square metres...”
Breakaway minute - “.....house 44 SHIELDS ROAD, DALKEITH, with solum thereof and ground attached, extending to 160 square metres”.
In subsequent transfers, minute: “.....house 44 SHIELDS ROAD, DALKEITH &c. extending to 160 square metres"
