Description of Property Must Be Acceptable

General

A key requirement for registration in the Land Register is that applications must provide a satisfactory description of the property to allow the Keeper to accurately represent that property on the cadastral map.

  • For DW applications, this must include the title number of the affected property, and may also include a new deed plan attached to the deed inducing registration (DIR) (for example, showing the extent of a newly created servitude right of access).

  • For FR applications, this may be by reference to a new deed plan attached to the DIR, by reference to a previously recorded or registered deed plan, or by reference to a verbal or bounding description contained in a previously recorded or registered deed.

  • For TP applications (& associated DW applications such as Deeds of Restriction, Standard Securities, etc), this must include the title number of the affected parent title, and will normally include a new deed plan attached to the DIR, although it may be by reference to a previously recorded or registered deed plan, or by reference to a verbal or bounding description contained in a previously recorded or registered deed. Another acceptable option for a TP that forms part of a parent title for which there is Development Plan Approval (DPA), is for the TP to describe the property by reference to the DPA scheme number and the individual DPA plot number(s).
