Garage Forecourts

General

Deeds of Conditions by SSHA (Scottish Special Housing Association) or their successors, Scottish Homes, are generally consistent in style and content. They will often make reference to garage forecourt areas, and impose burdens or encumbrances on those areas. If the individual property includes a garage forecourt area, this will be shown on the plan to the (Feu) Disposition by SSHA or Scottish Homes in favour of the original purchaser. Often, no reference to the garage forecourt area will be made in the (Feu) Disposition itself, but a plans reference should be provided as the legal setler will need to refer to this when including the Deed of Conditions in the title sheet.

 

Plans Reference

To ensure consistency in the plans references used for SSHA garage forecourt areas, a standard plans reference has been agreed. This will also assist the legal settlers when they are adding the deed of conditions to the title sheet as they will therefore be able to use the existing version of the deed on the LRS.

  • The garage forecourt must be tinted mauve.
  • A note (see below) will be appended to every SSHA/Scottish Homes Deed of Conditions, so it is very important that the mauve tint is not be used for any other purpose in SSHA/Scottish Homes titles, .

 

Legal Note

For information, the legal settler will ensure that the following note is appended to the Deed of Conditions entry in the burdens section of the title sheet. This note will be appended to every SSHA/Scottish Homes Deed of Conditions.

  • If there is included in this Title a right in a garage forecourt as specified in the above Deed of Conditions, the garage forecourt will be tinted mauve on the cadastral map.
