Sample Property Section Styles - Leases and sub-leases
- Editor9
When completing the property section for a lease or a sub-lease, it is important to remember that as well as giving the description/location of the leased subjects, you are also describing the lease's relationship with the cadastral unit (plot of ground). See Further Guidance section Mapping Leases for more information on the relationship between lease title sheets and cadastral units.
So, although only the tenant's interest in that cadastral unit is being included in the lease title sheet, a lease of the whole of that cadastral unit will be described as "Subjects cadastral unit.....". The real right field in the title sheet will state that it is the Tenancy that is included in the lease title sheet. If it is a lease of just part of the extent of the cadastral unit (a smaller area of ground or a flat/unit within a building) will the title sheet describe the lease as being "Subjects part of cadastral unit....."
Only a few examples of leases and sub-leases of whole or of part have been given below - these can be combined with the styles used for particular property types in the other Sample property section style pages.
When the leased subjects are part of a tenement - as with any other type of property within an tenement steading, the leased subjects may be described by reference to a plan or with a verbal description, provided it is an acceptable description of the flatted property/unit (see the exception to normal policy detailed on that Further Guidance page that can be applied if the deed plan in a lease is not acceptable but the verbal description is acceptable).

3. Sub-lease of whole
Remember, when deciding on the style of the property section description for a sub-lease, the distinction between a sub-lease of whole & of part is taken from the relationship between the sub-lease and the plot of land (ownership title, or the tenement steading cadastral unit), not between the sub-lease and head lease.

Remember, when deciding on the style of the property section description for a sub-lease, the distinction between a sub-lease of whole & of part is taken from the relationship between the sub-lease and the plot of land (ownership title, or the tenement steading cadastral unit), not between the sub-lease and head lease.
